Product Disclaimer, Risk Notice, and Limitation of Liability

Prepared People Training Services, LLC (“Prepared People Training Services,” “we,” “our,” “the Company”) operates under the trade name Prepared First Aid. By purchasing, possessing, or using any first-aid or trauma-related product offered through our company, including but not limited to tourniquets, pressure dressings, chest seals, hemostatic agents, bandages, kits, components, accessories, and educational materials (collectively, “Products”), the user (“you,” “purchaser,” or “end user”) acknowledges and agrees to the following terms, notices, and limitations.

This disclaimer applies to all Products sold online, in-person at events or shows, through third-party platforms, and within bundled or customized trauma kits.

1. Educational Use Only; No Medical Advice Provided

All information provided by Prepared People Training Services—including videos, demonstrations, verbal explanations, product descriptions, printed materials, and online content—is intended solely for general educational purposes.
Nothing provided by the Company constitutes:

  • medical advice

  • a medical diagnosis

  • a medical treatment plan

  • clinical guidance

  • a guarantee of effectiveness

Prepared People Training Services is not a medical provider and does not offer medical assessments, treatment recommendations, or emergency care consultation. All first-aid actions should be performed in accordance with local laws, recognized training protocols, and the judgment of licensed medical professionals.

2. Training Requirement and User Responsibility

Many Products offered by the Company—including tourniquets, chest seals, pressure dressings, and hemostatic agents—are intended for users who have received formal medical or first-aid training.

By purchasing or using these Products, you acknowledge and agree that:

  1. You are solely responsible for obtaining adequate training.

  2. You understand the risks associated with improper use.

  3. You accept full responsibility for any actions you perform with these Products.

  4. You will follow manufacturer instructions, safety warnings, and recognized first-aid guidelines.

Prepared People Training Services does not certify or qualify any purchaser for trauma intervention through the act of purchasing a Product or viewing Company content.

3. No Guarantee of Outcome

Emergency medical situations are inherently unpredictable. Factors such as injury severity, environment, time to definitive care, user skill, and product condition all affect outcomes.

Prepared People Training Services makes no guarantee, promise, or warranty regarding:

  • survival

  • treatment success

  • prevention of complications

  • pain reduction

  • wound control

  • stopping of bleeding

  • medical outcomes of any kind

Use of any first-aid or trauma-care product carries inherent risks.
The Company cannot and does not ensure that any Product will function as intended in all circumstances.

4. Product Limitations and Component Responsibility

The Products you purchase may include items manufactured by third-party companies. Prepared People Training Services:

  • does not alter, modify, or test manufacturer components;

  • is not the designer or manufacturer of most individual components;

  • relies on the representations and quality controls of original manufacturers;

  • is not responsible for product defects, material failures, or technology limitations inherent to those third-party items.

Any failure, malfunction, or degradation of a third-party item is the responsibility of the item’s manufacturer, not Prepared People Training Services.

5. Inspection, Maintenance, and Storage

The user agrees to:

  • Inspect Products upon receipt to verify condition

  • Monitor Products for wear, damage, contamination, or expiration

  • Store Products according to manufacturer guidelines

  • Replace expired or compromised components

Prepared People Training Services is not liable for issues arising from improper storage, exposure to heat/cold, water damage, contamination, packaging compromise, expiration, or user neglect.

6. Misuse or Modification of Products

Prepared People Training Services assumes no liability for injuries or damages arising from:

  • misuse

  • modification

  • repackaging

  • disassembly

  • improper application

  • deviation from manufacturer instructions

  • failure to seek medical training

  • or attempts to practice medical procedures beyond the user’s competence

Products must be used exactly as intended and must not be repurposed or applied in ways inconsistent with their original design.

7. Activation of Emergency Medical Services

All trauma care attempts should include immediate activation of 911 or local Emergency Medical Services (EMS).
First-aid tools do not replace professional medical treatment.
Delays in calling EMS dramatically increase risk of harm, complications, or mortality.

The Company will not be held liable for any damages resulting from failure to activate EMS promptly.

8. Assumption of Risk

By purchasing or using Products from Prepared People Training Services, you understand and voluntarily accept the risks associated with:

  • treating severe bleeding

  • applying a tourniquet

  • managing airway or breathing injuries

  • sealing open chest wounds

  • using hemostatic agents

  • providing care without definitive medical equipment

You agree that you hold full responsibility for your decisions and actions in any emergency scenario.

9. Limitation of Liability

To the fullest extent permitted by law, Prepared People Training Services, LLC—its owner, employees, affiliates, and representatives—shall not be liable for:

  • direct damages

  • indirect damages

  • incidental damages

  • consequential damages

  • personal injury

  • wrongful death

  • property damage

  • product misuse or misunderstanding

  • loss of data or opportunity

  • or any other harm arising from the purchase, possession, or use of any Product

This limitation applies regardless of the theory of liability, including but not limited to:

  • negligence

  • strict liability

  • product defect

  • failure to warn

  • breach of warranty

Your sole remedy in any dispute regarding the Products shall be limited to the purchase price paid.

10. Indemnification

You agree to indemnify, defend, and hold harmless Prepared People Training Services, LLC and its representatives from all claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • your misuse of Products;

  • your failure to follow manufacturer instructions;

  • your failure to obtain proper training;

  • your failure to seek professional medical care;

  • or any actions you take in an emergency situation.

11. No Medical Device Claims

Unless explicitly stated, the Company does not represent that any Product is FDA-cleared, CoTCCC-approved, CE-marked, ISO-certified, or compliant with any specific medical or tactical standard.
Claims about such certifications apply only to products whose original manufacturer explicitly labels them as such.

Prepared People Training Services does not make independent certification claims.

  • You accept all risks associated with the Products.

  • You agree to abide by all warnings, recommendations, and limitations.

  • You waive the right to hold the Company liable for any damages arising from the use or misuse of the Products.
